This is sad, very sad.
But, I must say that the officer was at least a little bit at fault here. And I would have to agree with the riders attorney, that the kid didn't know he was being chased. He was riding at night at over 100mph. That converts to 146.6 feet per second, so say by the time the officer, reacted, then slowed, made a u-turn, and accelerated (and full size SUV's don't exactly accelerate quickly!)I would have to assume at least 20-30 seconds passed in this time before the officer was truly in pursuit, if this is the case then that bike would have been over 4400 feet away, thats more than 3/4 of a mile away! Practically out of sight! So the trooper apparantly drove a 6000 lb. SUV beyond its, and the troopers abilities, lost control and wrecked, and was unfortunately killed.
This isn't to say that the kid isn't in the wrong here, but this is ridiculous. By this same logic, if I were to be pulled over for say not wearing a seatbelt, and the cop used poor judgement in darting out in front of traffic and was injured or killed , then would I be charged with manslaughter?
Folks, this is absurd! There is an assumed risk with any job, and that officer simply should have used better judgement, but I guess this goes with our "it's never your own fault, always blame someone else mentality!"
