Key switch goes on / off / lock / park.

You've got in park, not lock. Turn the key back one click to go to lock and your tail light (parking light) should go out.

already tried that...wasnt it

i did figure it out thought....bike had been wired funny it looks like in the rear...PO had replaced the stock turn signals with some smaller ones...looks like he might have wired it funny and never noticed or something
