Man pleads guilty to reduced drug charge

A Kansas City man who proved to be a tough collar for the Marshall Police Department has pleaded guilty to drug possession charges.
After initially facing felony distribution charges, Carlos Cortez McCain, 33, pleaded guilty to class A misdemeanor possession. He was fined $1,000 -- the maximum fine allowed by law.
McCain was arrested July 17 following a traffic stop and a scuffle with Marshall Police Officer Robert Coney. Coney stopped McCain for riding his motorcycle the wrong way around the Marshall square.
During the stop, Coney discovered the 2005 model motorcycle had license plates that expired in 1998. In addition, McCain was not licensed to ride a motorcycle and could not provide proof of insurance.
A further computer check revealed McCain to be on probation for drug trafficking. Coney asked for, and was granted, permission to search McCain for drugs and weapons, but McCain then fled on foot.
The foot chase led McCain and Coney into a dead-end alley where Coney was able to wrestle McCain to the ground. During the struggle, Coney was not able to handcuff McCain or call for backup, but was eventually assisted by a passerby.
Once searched, McCain was found to be in possession of 11 individually-wrapped bags of marijuana in his pants pocket.
Saline County Prosecuting Attorney Don Stouffer initially filed information charging McCain with class B felony possession of a controlled substance with intent to distribute. However, in Saline County Circuit Court Division 4 last week, Stouffer filed amended information changing the charge to misdemeanor possession. McCain waived further hearings and pleaded guilty at that time.
